Bring family of an asylee or refugee

If you were granted asylum or admitted as a refugee in the last two years, Form I-730 lets your spouse and unmarried children under 21 join you with the same protection. You file one petition for each family member, in the U.S. or abroad.

Requirements

What you have to show

Who can file

  • The principal asylee or refugee: the person whose own case was granted. A family member who got status through you can’t file for their own relatives.

Who can join you

  • Your spouse, if you were already married on the date you were granted asylum or admitted as a refugee.
  • Your unmarried children under 21 who were born, or conceived, by that date.

Deadline

  • File within two years of your grant of asylum or your admission as a refugee. USCIS can waive the deadline for humanitarian reasons.

The steps

How the case runs

  1. Gather proof of the relationship

Marriage and birth certificates, and proof of your own asylee or refugee status.

  2. File one Form I-730 for each family member

USCIS reviews each petition first, then sends it on to the office that serves the place your family member lives.

  3. An interview where your family lives

A family member in the U.S. is processed by the local USCIS office. One abroad is interviewed by a USCIS international office or a U.S. embassy or consulate before traveling.

How it works

How your petition gets built

  1. You answer simple questions

In English, Spanish, or Portuguese. The software puts your answers on the official USCIS forms.

  2. Your packet comes together

Your evidence is sorted into a numbered exhibit index, and your packet is checked for completeness.

  3. You file it

Download the assembled packet and file it yourself — or have an independent licensed attorney review and file it for you.

Pricing

What it costs

Your exact technology fee depends on your petition type and is shown during the free eligibility check, before you pay anything. USCIS filing fees are set by the government and paid by you directly to USCIS when you file, not at checkout.

Questions

Common questions

Is there help with the cost of a humanitarian case?

Need help affording your case? Contact our support team to ask about humanitarian discounts. Each request is reviewed by our team. USCIS filing fees go to the government, never to us, and your check shows exactly what applies to your case.

Who qualifies for a humanitarian petition?

These paths cover VAWA, T and U visa, asylee green card, and special immigrant juvenile cases. Answer a few simple questions in the free check and it tells you whether your situation fits one of them.

Is it safe to put my information here?

Your data is encrypted in transit and at rest. We never sell it or send it to USCIS, and it goes only to the service providers that make the product work. You decide when and how to file, and you can delete your account and data at any time.
