THIS AGREEMENT IS A DRAFT AND IS NOT YET IN EFFECT. welcome Plus and welcome Premier, the tiers that add services from an independent licensed attorney, are not available yet. This agreement applies only when they are, and only if you accept it before you buy one of them. Until then, welcome is self-help software with no attorney involved, under the consumer terms.
This agreement is between you and Marcia Giordano Hansen, an independent attorney licensed in Florida (Florida Bar No. 470767), of The Hansen Law Firm, P.A., doing business as Immigration Legal Center, 2625 Ponce de Leon Boulevard, Suite 200, Coral Gables, Florida 33134 (the “attorney”). The attorney is listed again in section 12.
welcomeUSA is self-help software. It is not a law firm, does not give legal advice, and is not a party to the legal services in this agreement. welcomeUSA does not direct or control the attorney’s professional judgment.
The attorney agrees to provide only the services listed in section 03 for the tier you buy. The attorney is not taking on your immigration matter as a whole. Unless you and the attorney agree otherwise in writing, the attorney does not represent you before any government agency or court, does not file anything for you, and does not have to help with anything that is not listed in section 03.
Because the attorney’s work is limited, you may prefer to hire an attorney to represent you fully instead. That choice is yours.
welcome Plus adds an independent attorney’s review of the application you prepared with the software.
welcome Premier adds an attorney consultation and help with a Request for Evidence (RFE).
Pending: exactly what each review and consultation covers, how the attorney gives you feedback, and when, will be set out here before these tiers go on sale.
Unless you and the attorney agree otherwise in writing, the attorney does not: represent you or appear for you before USCIS, the Department of State, the Department of Labor, an immigration court, the Board of Immigration Appeals, or any other agency or court; file or submit anything on your behalf; investigate the facts of your case independently; speak or write to anyone else on your behalf; or advise you on any other matter.
Pending counsel. If welcomeUSA pays the attorney for these services out of the price of your tier, it does so only as a payer. The attorney’s duties are to you, and the attorney keeps their independent professional judgment under the professional rules of the state or states where they are licensed. Paying through welcomeUSA does not make welcomeUSA your lawyer, or you welcomeUSA’s client for legal services.
You agree to give complete and truthful information in your application and in anything you send the attorney; to tell the attorney promptly about any change in your facts or circumstances; to consider the attorney’s feedback carefully before you decide what to do; and to keep copies of what you file.
You make every decision about your application. You decide whether, what and when to file, and you file it yourself. The attorney’s review is based only on what you provide.
The attorney keeps what you share confidential, as their professional rules require. welcomeUSA shares your application with the attorney only so the attorney can provide the services you chose. How welcomeUSA handles your information is described in the privacy policy.
The attorney’s review does not guarantee that your application will be accepted or approved, or decided within any time. USCIS and the other agencies decide every case.
This agreement ends when the attorney has provided the services included in your tier. You may end it sooner at any time by telling the attorney or welcomeUSA in writing. The attorney may end it sooner when their professional rules require or allow it, for example because of a conflict of interest. Whether any part of what you paid is returned is set by the refund policy.
This agreement covers the attorney’s services only. Your use of the welcomeUSA software is governed by the consumer terms, the privacy policy and the refund policy. Any change to this agreement must be in writing and accepted by you and the attorney.
By accepting this agreement before you buy welcome Plus or welcome Premier, you confirm that you have read it; that you understand the attorney’s services are limited to those in section 03; that you could hire an attorney to represent you fully instead; and that you had the chance to ask questions before accepting.
